Product Descriptions

While we aim for complete accuracy in our product descriptions and pricing, we cannot guarantee that all information is entirely free from errors or fully up to date. Mattress dimensions, for example, may vary by +/- 1 to 1.5 inches, which is considered standard within the industry.
In the event that a product is listed with incorrect pricing or details due to typographical or other errors, we reserve the right to cancel or reject any orders for that product, even if the order has been confirmed or payment has already been processed. Should your card be charged for a canceled order, we will promptly refund the full amount.

Product Pricing Information

We strive to provide competitive pricing on all our products. Any crossed-out or reference price displayed represents the Suggested Retail Price Comparison (SRPC). This price may or may not have been previously offered by us or other retailers and might not be available in the future. Additionally, similar or lower prices may be offered by us or other retailers during future promotions.
All prices are in U.S. Dollars unless specified otherwise. Taxes and shipping, if applicable, will be calculated at checkout. We reserve the right to modify product prices, adjust fees, or introduce new charges at any time without prior notice.

Online Store Terms

By agreeing to these Terms and Conditions, you represent that you are at least the age of majority in your state or province of residence, or that you are the age of majority and have given us your consent to allow any of your minor dependents to use this site.

We reserve the right to refuse service to anyone for any reason at any time.
Your content (not including credit card information) may be transferred unencrypted and involve transmissions over various networks and changes to conform and adapt to technical requirements of connecting networks or devices. Credit card information is always encrypted during transfer.
You agree not to reproduce, duplicate, copy, sell, resell or exploit any portion of the Service, use of the Service, or access to the Service or any contact on the website through which the service is provided, without express written permission by us.

Products or Services

Certain products or services may be available exclusively online through the website and may have limited quantities, and are subject to return or exchange only according to our Return Policy.
We have made every effort to display as accurately as possible the colors and images of our products; we cannot guarantee your monitor’s display will be accurate.
We reserve the right (but are not obligated) to limit sales to any person, region or jurisdiction, limit quantities, change descriptions or pricing without notice, discontinue any product at any time, and void offers where prohibited. We do not warrant that the quality of products or services will meet expectations or that any errors in the Service will be corrected.

Mattress Returns

Eligibility for Return — Mattresses are eligible for return within 90 days from delivery. To qualify, the mattress must be in good condition, free of stains, damage, or excessive wear. Mattresses showing abuse, neglect, or improper care may not be accepted.
Return Process — Contact support@mattressfoundations.com to initiate a return. Authorization is required before returning.
Return Shipping — We offer return shipping at no cost for the first return within the 90-day trial. Additional returns within the trial may require customer-paid shipping.
Refund Process — After inspection, we refund the purchase price minus a $99 return fee and any additional fees (e.g., shipping upgrades or international shipping). Refunds are processed within 7–10 business days to the original payment method.
Exclusions — Adjustable bases, foundations, pillows, and other bedding accessories are not covered by the mattress return policy (see separate sections).
Damaged/Defective Products — Notify us within 48 hours of delivery with proof (photos). We will arrange a replacement or refund as applicable. Promotional/expedited/white-glove/add-on service fees are non-refundable.
Modifications — We may modify or terminate this return policy at any time; changes apply to future purchases only.

Foundations & Adjustable Bases

Eligibility for Return — Non-returnable and non-refundable once delivered.
Inspection Upon Delivery — Inspect at delivery; report damage/defects within 48 hours with photos. We will arrange repair, replacement, or refund as necessary. Replacement shipping fees may apply.
Defective Products — We will work with the manufacturer under the product’s warranty.
No Trial Period — No sleep trial applies.
Non-Refundable Fees — Additional shipping, white-glove services, or custom modifications are non-refundable.
Modifications — Policy may be updated for future purchases.

Topper Returns

Eligibility for Return — Toppers are returnable within 30 days of delivery in like-new condition and free of stains/tears/damage.
Return Shipping Costs — Customer-paid; use a trackable/insured service.
Refund Process — Refunds issue within 5–7 business days to the original payment method after inspection; damage or not-like-new condition may reduce/void refunds.
Non-Returnable Items — Customized, used, or not-like-new toppers.
Exchanges — Available with an associated fee; contact support@mattressfoundations.com to initiate.
Modifications — Updates may apply to future purchases only.

Accessory Items

Eligibility for Return — Accessories (pillows, protectors, sheets, other bedding) are returnable within 30 days if unused, in original packaging, and like-new.
Return Shipping Costs — Customer-paid; shipping fees are not reimbursed.
Refund Process — Refunds to the original payment method within 5–7 business days after inspection; ineligible returns may be denied or incur fees.
Non-Returnable — Used/opened bedding, final-sale/clearance, custom/personalized items.
No Exchanges — Return and place a new order if a different item is desired.
Damaged/Defective Items — Report within 7 days; confirmed cases include return shipping.

Accuracy of Billing and Account Information

We may refuse any order. We may limit or cancel quantities per person, household, order, account, card, and/or billing/shipping address. If we change/cancel an order, we may notify you via the contact details provided at purchase. We may prohibit orders we judge to be placed by dealers, resellers or distributors.
You agree to provide current, complete and accurate purchase and account information, and to promptly update it (including email and card details). For more detail, review our Returns Policy.

Optional Tools

Access to third-party tools is provided “as is” and “as available” without warranties or endorsement. Use is at your own risk and per the third party’s terms. New services/features offered through the website will also be subject to these Terms.

Third-party links may direct you to websites not affiliated with us. We are not responsible for examining or evaluating their content or accuracy and assume no liability for third-party materials, websites, or products/services. Review third-party policies before transactions; complaints or claims should be directed to the third party.

User Comments, Feedback and Other Submissions

If you send submissions (e.g., ideas, suggestions, proposals, plans), we may edit, copy, publish, distribute, translate and otherwise use them without restriction. We have no obligation to maintain comments in confidence, compensate for them, or respond. We may monitor, edit, or remove content we deem unlawful or objectionable. Your comments will not violate third-party rights or contain unlawful/abusive/obscene material or malware. Do not mislead about identity. You are responsible for your comments.

Your submission of personal information through the store is governed by our Privacy Policy.

We may correct errors, inaccuracies or omissions (including in descriptions, pricing, promotions, shipping charges, transit times, availability) and change/update information or cancel orders at any time without prior notice, including after order submission. We have no obligation to update information except as required by law.

Prohibited Uses

In addition to other prohibitions in these Terms, you are prohibited from using the site or its content for unlawful purposes; to solicit unlawful acts; to violate regulations/laws; to infringe IP rights; to harass/abuse/defame/discriminate; to submit false or misleading information; to upload malware; to collect or track personal information; to spam/phish/pharm/pretext/spider/crawl/scrape; for obscene/immoral purposes; or to interfere with or circumvent security features. We may terminate use for violations.

Disclaimer of Warranties; Limitation of Liability

We do not guarantee that use of the service will be uninterrupted, timely, secure or error-free, or that results will be accurate or reliable. We may remove or cancel the service at any time, without notice.
Except as expressly stated, the service and all products/services are provided “as is” and “as available,” without representations or warranties of any kind, express or implied (including merchantability, fitness, durability, title, non-infringement).
In no case shall Mattress Foundations, our directors, officers, employees, affiliates, agents, contractors, suppliers, service providers or licensors be liable for any injury, loss, claim, or any direct, indirect, incidental, punitive, special, or consequential damages of any kind (including lost profits, revenue, savings, data, replacement costs), whether based in contract, tort (including negligence), strict liability, or otherwise, arising from use of the service or products, or for any claim related to use of the service or any product, including errors or omissions in content, or any loss or damage of any kind incurred as a result of use of the service or any content/product posted, transmitted, or otherwise made available via the service, even if advised of their possibility. Where exclusions/limits are not allowed, our liability is limited to the maximum extent permitted by law.

Indemnification

You agree to indemnify, defend and hold harmless Mattress Foundations and our parent, subsidiaries, affiliates, partners, officers, directors, agents, contractors, licensors, service providers, subcontractors, suppliers, and employees from any claim or demand (including reasonable attorneys’ fees) arising out of your breach of these Terms or your violation of any law or third-party rights.

Severability

If any provision of these Terms is unlawful, void or unenforceable, such provision shall be enforceable to the fullest extent permitted by law and the unenforceable portion deemed severed; the remainder remains in effect.

Termination

Obligations and liabilities incurred prior to termination survive. These Terms remain effective unless and until terminated by you or us. You may terminate by notifying us that you no longer wish to use our Services, or when you cease using our site.
If, in our judgment, you fail (or we suspect you have failed) to comply with any term, we may terminate without notice; you remain liable for amounts due up to and including the date of termination, and we may deny access to our Services (or any part thereof).

Entire Agreement

Failure to exercise or enforce any right or provision is not a waiver. These Terms and any policies/operating rules posted on this site constitute the entire agreement between you and us and govern use of the Service, superseding any prior or contemporaneous agreements, communications and proposals (oral or written).
